ESCO And Lyght Power Manufactured Products Warranty Policy

ESCO warrants that new products shall be free of defects in material and workmanship under normal use for a period of 18 months from date of manufacture or 12 months from date of sale, whichever comes first. This warranty extends only to the original purchaser and is non-transferable. This warranty does not extend to any ESCO product that has been damaged or rendered defective as a result of an accident, abuse or misuse, modification to the original product or the use of parts not manufactured or sold by ESCO or where the date code has been defaced, altered or removed. 

 

Prior to returning any product to ESCO, an RGA (Return Goods Authorization) must be requested. The RGA can be obtained by calling ESCO at (574) 264-4156. A copy of the approved RGA must be affixed to the product being returned. In addition, ESCO must be provided with a legible copy of the original date of sale, customer name and address, vehicle model name and/or number, vehicle identification number (VIN) and a complete description of the product defect. The shipping carton containing the returned product must display the RGA number(s) on the outside label. Failure to comply with the above procedure will result in the package being refused. 

 

ESCO will inspect and test the returned product. ESCO will, at its option, repair, replace or issue credit for any product found to be defective in materials or workmanship provided that inspection and testing show operating conditions have been within specified limits. Reasonable ground shipping charges will be reimbursed along with a labor allowance based on the dealer’s posted hourly labor rate as follows:

 

Transfer Switches up to .75 x Posted Hourly Rate

Cords, Cables, Break-Away Switches, SG Breakers up to .34 x Posted Hourly Rate 

 

If the returned product is found not to have any defects in material or workmanship, or is determined to be out-of-warranty, no credit will be given for the product nor any labor or shipping charges incurred. The product will be returned to the sender at the sender’s expense. 

 

No warranty will be issued for any of the following occurrences: 

1. Failure to return suspect product for warranty inspection. 

2. Failure to provide the required documentation as outlined above. 

3. Excessive power applied to the product. 

4. Reverse polarity power applied to transfer switches. 

5. Burned wiring due to improper connection to the product. 

6. Breakaway switches that have melted or been damaged due to improper use. 

7. Power cords that have melted, been dragged across the ground or otherwise damaged. 

8. Date code labels that have been altered, defaced or removed. 

9. Any modifications made to the original product. 

10. Damage due to an act of God. 

11. Return shipping damage due to inadequate packaging of product. 

12. Product that is out-of-warranty. 

 

ESCO’s obligation to repair, replace or issue credit for a defective product is the sole and exclusive warranty made by ESCO. No implied warranty of merchantability or fitness for a particular purpose is made, intended or implied and all such warranties are expressly excluded. In no event will ESCO be liable for consequential damages, including but not limited to loss of profits or revenue, loss of use, inconvenience, loss or damage to personal property, cost of capital, cost of subsequent equipment, facilities or services, downtime, claims of third parties and costs incurred in removing and installing the product. This warranty does not protect against acts of God such as direct lightning strikes, earthquake, flood, war, vandalism, theft, normal use wear and tear, erosion, depletion, obsolescence, abuse, damage due to low voltage conditions (brownouts, sags or power interruptions), modification or alterations to the original product. 

 

ESCO WILL PROCESS ALL WARRANTY CLAIMS WITHIN 30 DAYS OF RECEIPT OF CLAIM AND MATERIAL. NO DEBITS WILL BE HONORED WITHOUT PRIOR CREDIT BEING ISSUED BY ESCO.
